In an article published March 24, 2024, in The Conversation — Amazon, SpaceX and other companies are arguing the government agency that has protected labor rights since 1935 is actually unconstitutional" — Columbia Law Professor Kate Andrias challenged the corporate claims that the National Labor Relations Board is unconstitutional.
Andrias, the Patricia D. and R. Paul Yetter Professor of Law and a member of the Center for Political Economy's advisory board, wrote that if such claims made by Amazon, SpaceX, Starbucks and Trader Joe's "prevail, the entire process for holding union elections and for prosecuting employers who break labor laws – in place since the days of the New Deal – could collapse."
